Legal Statement
The owner of this site, Single Market
Ventures sprl of Brussels, Belgium (referred to below as THIS
COMPANY or THE COMPANY), draws the attention of all users to the
following conditions of use.
1. LIMITATION OF LIABILITY
The company accepts no liability for
the consequences of use or misuse of its reports, recommendations,
or advice. Much of the material on this site presents analysis and
information assembled by this company, in a field where new and
updated data is constantly emerging. The company's editorial material
presents the latest information available to the company, and also
presents the company's view of relative priorities and consequences
of the developments to which the information refers. The company
uses a wide range of sources, published and unpublished, and normally
uses data which is in the public domain. The company warrants that
its work is performed with due diligence, care and attention, but
makes no claim to include references to every item of conceivable
relevance, makes no claim to refer to data not in the public domain
even when such data may be demonstrably relevant, and makes no claim
to legal certainty in its interpretation of the developments it
reports.
The company accepts no liability for the
content or interpretation of third-party texts presented on or via
this site. In the case of official documents originating with EU
institutions, only the European Community's legislation printed
in the Official Journal of the European Communities is deemed to
be authentic, and only the European Courts have the right to issue
legally binding interpretation of that legislation. The European
Commission itself issues a legal notice to indicate that the distribution
of its texts is subject to a disclaimer and limitation of liability
which are applicable to texts made available indirectly through
this site.
Further detailed limitations of the
company's liability appear in the paragraphs below.
.
2. COPYRIGHT AND TRADE-MARK
Material made available on this site
includes material developed by this company and publicly available
material developed by outside organisations and made available as
a service by us.
For all material developed by the company
and presented on this site, the company asserts its copyright. The
company considers the name of the company itself and the name of
the Europe-link Service on EU Product Approvals to benefit from
trade-mark protection. Except where expressly agreed in writing,
material developed by this company and presented on this site may
be downloaded as a single copy only to a single computer connected
to a single user screen, and may not be printed or otherwise reproduced
or distributed as more than a single copy, regardless of whether
such copies are sold for payment or distributed free-of-charge.
It is the company's commercial policy to negotiate multiple-user
and copying arrangements with individual clients in individual contracts,
and any client or user is welcome to contact the company to enquire
about conditions for such arrangements. Any such individual contract
may override the copyright conditions presented in this paragraph,
but in the absence of any such user-specific contract, the copying
restriction above applies. The company reserves the right to claim,
from any person or company making unauthorised copies or unauthorised
electronic transmission of our material, the full purchase or subscription
cost for such copies as well as compensatory damages.
For any document developed by any other organisation
and quoted or otherwise made available by us via this site, the
company makes no claim to copyright or to any exclusive reproduction
rights. That applies notably to official documents and to links
to Internet sites of European institutions or government organisations,
who retain the copyright to documents produced by them, and whose
support we are happy to recognise in making their information available
free-of-charge to a wider public audience. [An example of such information
is that available on the europa server of the European Commission.]
Such third-party material may itself be subject to copyright restrictions
imposed by the original author. Appearance of a third-party text
on this site does not indicate that that text is free of copyright
restrictions.
3. USE AND MIS-USE OF PASSWORDS
Much of the material on this site is
accessible only through the use of an authorised password issued
by this company, and passwords are issued only after signature of
a written agreement on the terms of its use. Those terms invariably
include restrictions on communication of the password to other individuals
and other organisations.
You agree not to copy or transfer any password, or cookie containing
your password or authorisation to access our site, to any person
or organization without our written authorisation. We reserve the
right to monitor usage of any password or user name used to access
our Internet site.
If evidence reaches the company that a password
is being used by an unauthorised user, the company reserves the
right to terminate all access by that password, and immediately,
and to cancel any contract between the registered holder of the
password and the company. In any such case where a password-holder
is a subscribing client to our services, the company will communicate
the evidence to the client, will acknowledge receipt any explanation
which the client provides, and will attempt to re-instate access
by the client if conclusive evidence is produced that the client
did not breach the terms of access.
A registered password-holder who communicates
his/her password to an unauthorised third-party accepts full responsibility
for the use or mis-use of any information obtained from this company
by the unauthorised third-party, and for any damage caused to the
company as a result, for example by hacking or sabotage.
4. PRIVACY
The company respects the privacy of
personal data and of commercial data we receive from our clients
and registered users on their activity. We allow any client for
our services who wishes to do so to specify that any personal information
he provides should only be used for purposes directly related to
the reasons for which it was originally provided to us, and not
for purposes unrelated to those reasons. We do not communicate telephone
contact numbers to third-parties who we believe might make unsolicited
telephone calls. We take all reasonable measures to prevent the
loss, misuse, alteration, disclosure of information clients provide
to us, or unauthorised access to that information. We respect the
confidentiality of any data which any client provides on the client's
markets, products, or finance unless such data is in the public
domain, and of any detailed financial information such as bank accounts
or credit card references. Payment details requested over the Internet
are channelled through recognised third-party systems offering encryption
and other security features to prevent leakage of data.
The company seeks to collect and analyse
data on visits to this web-site for its own purposes only, and with
the primary objectives of preventing misuse of the site, and of
identifying opportunities for improving our service through the
site. The company therefore reserves the right to use, for any purpose
whether commercial or non-commercial, any other data supplied by
any user of this site other than the confidential data listed in
the previous paragraph, and notably log-in access data or what is
commonly called clickstream data (information from visits to our
sites, the domains from which people visit, and measures of visitor
activity), but will make reasonable efforts to restrict access to
such data on receipt of an explicit, written request from any user.
We may use "cookies" (elements of data that a Web site
can send to your browser, which may then be stored on your system),
which offer you various options if you wish to block them: for example,
you can set your browser to notify you before you receive a cookie,
giving you the chance to decide whether to accept it, or you can
also set your browser to turn off cookies, although if you do that,
some areas of our site may not function properly.
